Normal practice seems to be to get paid half the sum on getting half the job done, and not continue if the payment doesn't materialise. Like, finishing the high-res model untextured.
Do NOT continue if the agreed milestone hasn't been paid.

Nothing yet Eduardas. I'm not doing any more changes on the model, at this point I feel as if the client is in breach of contract.

I think the customer would be pay before to CGTrader!!!! If the product is not correct CGT will refund your money, CGT must be ...the judge !!

Well over 2 month, going on 3 months now. I did everything I had to do up until this point. Modeled, Revisions, additional revisions, waited over a month for pay and a response, finally got a response from both CGTrader and The client whereas the client wanted me to revert back to a prior change. I did that 3rd revision as well, in hope that I would now get paid. I'm now at 3 revisions already and still no payment for any work. CGTrader also informed me that they are able to see the timeline, so I don't know what the problem is at this point. Do I have to wait until the 20th of next month (the New Year) to get Paid ??? Happy Holidays...... SMH

Hi Guys,

It was a bit tough to contact the buyer of the mentioned job, we are very sorry for the inconvenience that was cost.

We have finally reached the buyer and he was not satisfied with the product enough. As the Job Agreement states: "If an objection regarding the quality has been filed by the Buyer, the Designer will be notified by CGTrader after which the Designer can either agree to amend the Product, or present a counterargument to the claims presented by Buyer. In the latter case CGTrader will make a decision regarding the quality of the work following the procedure set forth in subsections 13 and 14."

The Designer was continuing work with the buyer, but it seems as though the satisfaction from both sides cannot be reached.

As we are obligated to make the final decision, we have agreed with the buyer, that the designer gets 1/3 of the agreed payment, as we do not want to leave him with nothing after the hard work he put in to the job.

Your Policy
7.1. After Designer has submitted the Product, Buyer is deemed to have accepted it if he or she has opened the submitted Product and has not lodged an objection regarding the quality in 10 business days after initially opening the Product.

This is now twice the buyer has let more than 10 days pass after revisions were made. Like I said, in breach of contract. My spouse is currently in law school, so I look very careful into these things. I've spent well over three months on this project alone. This is your company's policy. The buyer and I did discuss changes 1, then twice, and now a third time, two of those times were well after their 10day period.

Hi Jacob, The main problem here is that he did contact us On October 29, after you've uploaded the model on October 24 and he was still not satisfied with the product. It is a problem he didn't contact you during that time, but even after the last changes the buyer was not completely satisfied with the job and he doesn't believe that it will be done according to his needs.

The terms also stipulate that I may proceed with a counter complaint, whereas you company views the images or references provided by the buyer against the work that I have done for the client. I will definitely provide all the information that I have to help support the fact that I have made adjustments and ask what was required by the buyer. I also want you to know that the buyer had one reference picture of the T1000 model from the terminator movie, and wrote up that the other two aspects of the model should resemble Batman, and Wolverine, from the DC and Marvel Comics. The model was to be a crossbreed of all 3. Furthermore; any additional image reference that the client had used were of my model, so how is it that if the reference is from my design, it didn't look or resemble what the client had in mind? That makes no sense, if the buyer started to use my design as a reference, how could it not be fitting of what was needed. I still have all screenshots and modifications for the model if you need it. All it takes is a review of the reference(s), the, modification, and my designs, for your company to see that I did all that was asked of me. >>>>Additionally the buyer also asked me to revert back to a prior change<<

We will take a further look on this issue and come up with a response on solving this problem to leave it completely resolved. We certainly do not want to leave anyone unprotected. We will come with a further response tomorrow.

After looking further through the conversations and sent models, we decided to split the price of the job offer in half and give both the buyer and the designer 1/2 of the previously agreed sum. That is because the job was sadly not satisfactory enough for the client even though it looked it would be for some time until the last model the designer have sent him.
Otherwise, buyer did breach the terms of the contract by not responding personally to the designer in time. Since both sides are not satisfied, and we felt that the designer have put in a lot of work - even though the model was not finished to the buyers demands, it did require time from the buyer. That is why we have decided to give both of parties the 1/2 of the previously agreed price.

"Model looked good until designer sent final files to buyer" - sorry, but it looks like scam to me. The fact that one have to model and then give all files without any upfront payment, makes this system very unfavorable to designer. As a designer i can't see any benefits fom geting jobs through cgtrader, only downsides. I don't feel protected at all.

Model looked good, but it didn't meet the demands of the buyer, who kept asking for the few additions and fixes that weren't done according to him. In addition to the detail requests, the buyer also asked for the model to be a bit more simple and mentioned that the first version of the model was the closest to his demands. The final files that the designer sent to the buyer were not satisfactory for the buyer. The upfront payment, however, is a good idea, which will be discussed further, as we are currently looking to upgrading some rules of the job agreements, so that we do not come into situations like this again.

I would hope that I do not run into this issue any more. I think changes should be made as well as limits to how many times a client changes the models. This was my first selling experience here on CGTrader and it turned out to be a bad one. I have a ton of models that I would like to add on here but after this I don't know. Changes definitely need to be made. Especially if the Client doesn't contact the buyer after the 10 day grace period for changes. The sale should be final for the agreed costs. That's what contracts are there for. Ed you said it yourself, "buyer did breach the terms of the contract by not responding personally to the designer in time". Check you inbox, I'm still waiting for my partial payment. Nov. Oct. Dec. 2015 we are now in Jan 2016. Where I'm from that breach would have resulted in a court dispute for way more than what was in the contract.

Also, I don't advise any artist upload the models files here, just put the images up and wait until the client actually states that they want the Model. This way there's no back and forth. Model modification limits, no file uploads (strictly images), until the client agrees to the final product, and Artist should receive a portion up front so that the client is more likely to care about the product they are purchasing.

I understand the dissatisfaction of this job, it was an experience we're hopeful will not occur again.
However, as Jacob has mentioned the uploading models - I can assure you that the selling experience is a different one from the one he's had.
We're working hard on the details of the 3D Jobs, so that the designer would both be and feel more secure and satisfied with approaching these jobs.
It is a bad experience - but a learning one nonetheless, and we're very thankful for Jacob's patience and open-minded approach to this issue as it will help us develop the 3D jobs that will be more satisfying, attractive and safe for both parties.

I saw the final product looks pretty good and Jacob's right.
I think in the future the clients should receive feedback from the artists !
