Plagiarism ?

Hello,

This morning I decided to modelize my living room (my real life one). I started by my bookshelf, once finished I wrote the entire post and started wondering what tag people were using.

So I went to check on the website, in shelf category. To my surprise I found the exact same bookshelf !

For now, I didn't post it because it's not just similar, it's exactly the same one but now I'm wondering if I can actually do anything ?

If I list it on the site, is it counted as plagiarism ? But then how to be sure to not enlist a model someone is already selling ? We can't really check all the available models through the X pages I assume.

I most likely won't post my shelf because I don't want to not be seen as a "copypasta" person, but I didn't seem to find anything related to such situation on the forum, maybe I just missed it or didn't search enough.

Sorry, I'm a little confused. Is that shelf you posted based on a real-life product? Or did you invent the design and look of it yourself?

It's not illegal. The only issue is when you model something in the real world that has a brand name or brand identity that the company wants to protect. BMW, for example, was going to sue people who modeled their cars without permission and some model stores were forced to remove their cars from the list of models. This was years ago, but that's just an example. In your case, there's nothing you can do about someone else creating that same exact object and uploading it to sell since you did not invent that object in the real world to begin with. In other words, it's not a unique object and you don't own the brand.

If you made model of real world object why you care that someone else did it before you?
If someone makes Audi A6 model that doesn't mean no one else is allowed to make it also.

About the laws.. if you are profiting on someone else design (furniture company in this case) you are violating IP/copyright law.
But everyone is doing it so you can too.

That is a law created out of thin air, there is no law in existence stating, “when several people do not abide the law then you are also allowed to not abide it”. Copyright infringement is illegal no matter how many people are doing it.

I predict in the near future all companies that produce real life products will realize that they can also sell their designs in digital form, to be used in all kinds o f VR and game environments, so in my opinion is not a good idea to model real life designs. It would be better to design your own objects from scratch, but then, that is easier said than done.
